General Terms and Conditions of Business for perlaprincipessa
1. Scope of Validity
These General Terms and Conditions of Business (T&Cs) regulate the conclusion, content and processing of purchase agreements for products from perlaprincipessa GmbH (hereinafter referred to as perlaprincipessa).
2. Concluding Agreements
2.1 The depiction of products on the www.perlaprincipessa.com website does not constitute a legally binding offer, but an invitation to place an order.
2.2 By submitting an order, the purchaser sends a legally binding offer to conclude an agreement and accepts these T&Cs.
2.3 perlaprincipessa will accept the order by sending the purchaser a purchase confirmation by email. The purchase agreement is created by this email. Confirmed orders can no longer be cancelled or amended by the purchaser.
2.4 perlaprincipessa does not send products to minors.
2.5. In respect to colour and size, the delivered products may differ from the original that is depicted on the website due to different screen settings.
3.1 Items are purchased by advance payment. If perlaprincipessa cannot confirm receipt of payment within 8 working days of the order, the order will be cancelled.
3.2 Generally, ordered products will be sent only to addresses in Europe. Deliveries to countries that are not listed above may be possible upon request to (info(at)perlaprincipessa.ch). Other delivery conditions and fees apply to deliveries outside of Switzerland.
3.3 At perlaprincipessa, our love of handicraft and detail really stands out. Each piece of jewellery is created for you with love, and we endeavour to fulfil our customers’ wishes. We offer the following delivery periods:
- Switzerland and Liechtenstein: 20 working days from verified receipt of payment.
- Shipping in EU states as per 3.2: 25 working days from verified receipt of payment (the post office requires 3-5 days extra for shipping to EU states).
The delivery period may vary depending on the product. If delivery periods are going to be longer, we will inform you of this by email in a timely manner.
3.5 The benefits and risks are transferred to the purchaser when the products are sent for shipment. The delivery will be made by Swiss Post at the risk of the purchaser. perlaprincipessa does not assume any liability for damages to the product that are caused during shipping. perlaprincipessa is not liable if the product is stolen during shipping or after delivery.
3.6 The following packaging and shipping costs apply:
- Switzerland and Liechtenstein: CHF 0.00
- Shipping to EU states as per 3.2: CHF 0.00
Also in the case of an exchange, the exchange item will be sent without charge.
3.7 When an order is imported into the delivery country, the customs office will collect the VAT, customs charges and processing fees that are typical in the relevant country. 4.1 Payments from purchasers may be made through advance payment as a bank transfer or by using PayPal.
4.2 The purchaser may choose to make the payment by bank or postal transfer as well as by credit card (PayPal). perlaprincipessa will provide the purchaser with the bank details in the purchase confirmation and will deliver the products after payment is received.
The prices that are shown on the internet site are in Swiss Francs, or you can choose to see them in euros. There is no minimum order value at perlaprincipessa; we are happy to receive any size of order. The prices that are indicated on the date of ordering are binding.
6. Data Protection
Customer data will be saved exclusively for processing the order and will not be shared with third parties.
7.1 The purchaser will examine the ordered product immediately, but, at the latest, within 2 working days of receiving the goods.
7.2 perlaprincipessa provides a guarantee of 12 months from the product delivery date. During the guarantee period, perlaprincipessa will resolve defects free of charge, even if these first arise after the delivery date of the product to the purchaser. The purchaser will notify perlaprincipessa of the guarantee case by email to .
7.3 After the expiry of the 12 month guarantee, the purchaser’s warranty claims will be subject to a statute of limitations pursuant to article 210 OR [Swiss Code of Obligations]. The warranty for defects will extend for a further 12 months. This warranty only includes defects that already existed upon the delivery date or which arise within 12 months of this date (hidden defects). The purchaser will immediately notify perlaprincipessa by email to about any defects that subsequently arise. If the purchaser fails to provide timely notification, the guarantee claims will be invalidated.
7.3 If the purchaser makes a defect claim during the guarantee or warranty period, a repair of the product may be requested free of charge (free repair). The defective product must be sent back with the guarantee certificate. Any transport costs that are incurred will be borne by the purchaser.
7.4 If perlaprincipessa is unable to repair an item or if it is too expensive to do so, perlaprincipessa may deliver an equivalent replacement product or refund the purchase price.
7.5 If perlaprincipessa does not repair a defect within an appropriate period and if the product is also not exchanged, the purchaser has the right to make a deduction from his/her payment corresponding to the reduction in value (reduction) or to rescind the purchase and demand a refund of the sum already paid (refund).
7.6 The guarantee and warranty exclude normal wear and tear (e.g., slight loosening of the necklace), the consequences of improper treatment or damage by the purchaser or third parties, and defects that are the result of external factors (e.g., oxidisation of silver).
8. Exchange or Credit in the Case of Dissatisfaction (Dislike)
8.1 perlaprincipessa makes every effort to provide the best possible products and services. If a product does not meet the purchaser’s expectations for a specific reason, the purchaser has the option either
a. to send back the product and exchange it for another product of the purchaser’s choice, or
b. to send back the product and request a credit in the amount of the purchase price that was paid.
8.2 In both cases, the product must be sent back in the original packaging, in an unused and complete state. perlaprincipessa cannot otherwise accept the return.
8.3 Returns are made at the purchaser’s cost and risk.
8.4 The purchaser does not have a right to reimbursement of the purchase price upon returning products.
8.5 In accordance with applicable Swiss law, the purchaser has no legal right of rescission as a consumer. perlaprincipessa therefore has no corresponding notification duties in this respect. Since the products from perlaprincipessa are not made in advance or in series, but only on the basis of orders from purchasers, and are made by hand and in accordance with purchasers’ personal requirements/specifications, the exclusion of the legal right of rescission also applies in relation to purchasers from neighbouring European states.
9. Exclusion of Liability
Liability claims from the purchaser – irrespective of the legal reason – are excluded, insofar as this is legally permissible. In particular, perlaprincipessa is not liable for damages that do not arise to the product itself, in particular, for consequential damages resulting from defects, lost earnings or other financial losses that are sustained by the purchaser.
10. Retention of Title
In all cases, the product remains the property of perlaprincipessa until payment for it has been made in full. perlaprincipessa is entitled to make a corresponding entry in the registry of retained titles.
11. Final Provisions
11.1 If these T&Cs or parts thereof are or become invalid, the validity of the remaining regulations will remain unaffected by this.
11.2 Any General Terms and Conditions of Business of the purchaser are expressly excluded.
12. Applicable Law and Competent Court of Jurisdiction
12.1 The legal relationship between perlaprincipessa and the purchaser is subject to Swiss law. The UN Convention on Contracts for the International Sale of Goods (CISG) is explicitly excluded.
12.2 The competent courts are the ordinary courts in Brig (Switzerland / Wallis Canton). Mandatory statutory provisions remain reserved.
